ACV application refused by HBC

 

On 30th August HBC informed the HJCP that their application to have the ACV reinstated on the ‘eastern-annexe’ of the Henry Jenkins had been unsuccessful. The letter stated that we have provided insufficient evidence to prove that:

a) That primary use of the building in the recent past furthers the social well-being or social interests of the local community

b) That it is realistic to think that now or in the next five years there could continue to be primary use of the building to further the social well-being or social interests of the local community.

There can be no appeal against this decision but, with new evidence and submissions, a re-application can be made. The Management Committee is considering the options.

Pub purchase offer rejected

Mr Fielder rejected our offer to purchase the Pub which we sent July 3. He was quite open in telling us he wants to sell at a price that recoups ALL of the costs he has incurred over the last 8 years, including the costs of his failed appeals!
This is the second time an offer in line with an independent valuation has been rejected by the owner.

Offer to purchase Pub sent

An offer to purchase both parts of the pub was placed with the owners, David Fielder & Justin Claybourn.
Copies were sent to Harrogate Borough Council and the local Parish Council were notified.
This bid falls within the moratorium time given after the owner of the Pub notified that it was for sale.

Preconditions to meeting unacceptable

We wrote to David Fielder requesting a meeting to negotiate the purchase of the pub.

Unfortunately, he replied with preconditions, insisting that any such meeting include a justification by us of our future plans, followed by an offer of £250k (or close to) for half of the pub!
Of course, these preconditions were totally unacceptable and, as the building is derelict and worth nowhere near that sum, the meeting did not take place.

We await Mr Fielder’s agreement to commence negotiations without preconditions.

Public Meeting Answers Many Questions

A successful public meeting was held in the Mechanics Institute at Kirkby Malzeard on the 17th June.The meeting was well attended with 40 – 50 people in the audience and representatives from CAMRA, the George and Dragon Pub and the charity “Locality” were in attendance ..

After a review of the first meeting, an open question and answer session was instigated where any person could ask any question regarding the HJCP plans for the future of the Henry Jenkins

The existing owners of both parts of the property, David Fielder & Justin Claybourn were in attendance and engaged in the lively debate. During the discussion, Justin Claybourn revealed that his property, the so-called ‘eastern annexe’, which he was calling the ‘Old Joiners Shop’, was also up for sale.

Towards the end of the meeting, a member of the audience urged both parties to arrange a meeting to properly discuss the possible purchase of the site by the HJCP and pushed for a provisional date to be agreed then and there, in front of the live audience.

All parties agreed to meet, on a date after the 10th July, at a place and time specified by Mr Fielder.

Both the public and residents meetings in the MIVH, were professionally produced, with information projected onto a large screen, and formal presentations given by the HJCP Management Committee and the guest speakers. They have helped inform the community about the Business Plan & Share Offer (both audited and granted a Standard Mark (Kite Mark) by the Community Shares Unit), and the campaign to purchase and refurbish the pub, with reference to other successful similar campaigns from around the UK
