The Appeal by David Fielder’s associate Justin Claybourn against the refusal of his recent planning application was activated on 31st January 2020. As expected, and previously mentioned, a formal Hearing, presided over by an Inspector from the Planning Inspectorate in Bristol, will be held in Harrogate on a date yet to be announced. Comments on the appeal have been invited to arrive no later than the 6th March. The HJCP Ltd urge everyone who has an interest in this situation to forward their opinion to the inspector. Your views are important, will be considered and could make a difference.

Will Parry, who has lived in Sawley for 3 years, will provide expert advice on Land & Property. A fully qualified Surveyor, after a career working within the established rural property agency industry, Will is about to launch his own Brokerage, Property and Valuation business.
Mark Owen, a 25-year resident of Kirkby Malzeard, will advise us on Legal & Governance matters. Mark works in the Leeds office of, and is a partner specialising in commercial property at, international law firm Womble Bond Dickinson. Both these appointments will expand our range of experience and expertise and will elevate our future approach to another level of professionalism

When the HJCP submitted an updated progress report to local parish magazine, ‘The Fountain’, in late November, for publication in December of 2019, our membership was 141 and the community shares we had sold amounted to £110,00. By the time we had submitted for the February edition our membership had swelled to 155 and the community shares to £174,250.00.
These figures have continued to rise, and to date – 30th January 2020 – are 157 and £177,500.00 respectively. Amazing! Thank you, parishioners!

The HJCP would like to thank the Plunkett Foundation for renewing our membership, commencing Monday 25th November, and, in addition, under the More than a Pub: Community Pub Business Support Programme, granting us a bursary of £2,500.00, which will help pay for all the ongoing day-by-day expenses of conducting our campaign, and several days of face-to-face specialist consultancy advice.

On the 7th November, although it has not yet been activated, David Fielder’s associate Justin Claybourn lodged an appeal against the refusal of his planning application on the ‘eastern-annexe’ of the Henry Jenkins with the Planning Inspectorate in Bristol. When activated, after due process, a Planning Inspector will adjudicate at a formal Hearing at the HBC offices in Harrogate. Prior to this the public will be invited to make representations for and against the appeal.
We hope that all members of the HJCP and other residents of the parish will rally to the cause and object to this particular application by Mr Claybourn and all other planning applications which seek to change the wonderful Henry Jenkins Inn, which has served Kirkby Malzeard for nigh on 200 years, into domestic dwellings. It is difficult to see how the Planning Inspector could reasonably grant the appeal when faced opposed by 200+ letters and by a comprehensive, fully worked-out business plan for the regeneration and refurbishment of our ancient landmark.
The HJCP will keep members fully updated as to the progress of the Appeal and full details of how and when to forward any submissions.

Wednesday 4th December. A meeting was held in Harrogate with Mark Codman, Legal & Governance Officer and Rachel Bowles, Corporate Affairs Director of HBC. The frank and detailed discussion centred on why HBC had refused the re-establishment of the ACV on the ‘eastern-annexe’ of the Henry Jenkins Inn. They gave us several reasons. a) They regarded this application as a ‘stand-alone’ so the evidences from previous applications which were referred to and referenced by the new application were not sufficient. b) In their opinion, there was not enough evidence that the ‘eastern-annexe’ had existed as a social facility prior to 1975. c) The time that had elapsed since the pub was last open serving the community now did not satisfy the criteria of ‘the recent past’ even though a large amount of that time was because Mr Fielder would not sell and allow the pub to open. The HJCP disputed the logic of all these decisions and were given to understand that another application can be made with fresh evidences provided to address the perceived shortcomings of this one.The HJCP are now preparing the groundwork for another new application

A Great Reaction to the ‘Crunch Time’ leaflet has led to a dramatic increase in sales of  Community Shares in the Henry Jenkins. The total, as of 30th November, now stands at £170,750.00 which is 74% of our ambitious target! WELL DONE EVERYONE! The target figure we set – £230,000 – now really does seem achievable. Our membership figure has risen to 149, which is fantastic and the management team can’t wait for the magical number of 150 to be registered. These are great results for a small community like ours but we should not forget that we still have a way to go so please keep spreading the news to try and bring in more members and additional investment. Together we can, and will, ‘Save the Henry Jenkins’! 

On Monday 13th November, Janet, Dave (Chairman) and Bryan (Treasurer) attended a seminar in Leeds, hosted by the Plunkett Foundation. Attendees from a number of Community Shops and Pubs from a wide area discussed their own particular situations and received information and support from specialist advisors. One fantastic success story came from the team from the White Horse in Church Fenton who, supported by their parish council, have benefited from a Public Works Loan in excess of £350,000.oo (!!)  to enable the purchase and refurbishment of their pub. A meeting between HJCP and officers of the HBC to discuss the decision not to reinstate the ACV on the ‘eastern-annexe’ of the Henry Jenkins Inn, has been arranged at the Council Offices in Harrogate for 11.00 am on 4th December 2019.
