The AGM of the HJCP Ltd, delayed because of the pandemic, is now in process, taking place over a number of days ‘virtually’ by email. The formal AGM announcement and reports by the Chairman, Treasurer and Secretary have now been issued to the entire membership.

Your vote is very important – please do complete and return!

We also value transparent and open dialogue with our members so please do not hesitate to contact us on HJCPLtd@gmail.com with any questions, queries, comments and opinions. We promise that every submission will receive a reply.

A Casual Vacancy

Parish Council – Casual Vacancy

A Kirkby Malzeard Councillor has left the Parish Council, therefore leaving a Casual Vacancy. The options to fill this vacancy are:

1:         If 10 Kirkby Malzeard residents request it by 23rd October 2020, a proper public election will take place but not until May 2021 earliest – see village website for details.

2:         If no such request is made, the PC will advertise the vacancy to Kirkby Malzeard residents with the aim of co-opting someone . Details of this will be issued by the PC in due course – watch the village website.

3:         If there are 2 or more nominees for the co-opted position, the PC will hold an internal vote to choose.

4:         A PC vote to co-opt someone is likely to happen at the November PC meeting (23rd Nov).

A creative, strong and caring parish council is pivotal in creating a sense of ‘community’ and the HJCP looks forward to working closely with the Kirkby Malzeard, Laverton and Dallowgill PC in the future, when the Henry jenkins has been restored to it’s former glory.

So, if you feel you would like to serve the parish by becoming a councillor, please consider putting your name forward now. Your village (and your Henry Jenkins) needs you!

If you would like to discuss what is involved in becoming a parish councillor, please don’t hesitate to contact me , or any existing councillor.

HJCPLtd AGM

NOTICE IS GIVEN OF THE HJCP LTD ANNUAL GENERAL MEETING (AGM) TO BE HELD 26TH OCT 2020

How the AGM will work

Due to the unusual circumstances of operating in the COVID era and the legal necessity of having to conduct an AGM, we propose to conduct the AGM via email with documents, reports and votes all conducted electronically. This will remove the need for a large gathering, reduce the chances of the Kirkby Malzeard internet connection melting down as all the members try to connect to a Zoom call at the same time, and allow people to vote, share their opinions and consider the issues in their own time.

  • Reports from the committee, the accounts and voting forms will be emailed to all members on the 26 October 2020.
  • Comments, nominations for committee members and voting forms should be returned by 28 October 2020.
  • Minutes will be issued to all members by 29 October.
AGM agenda

  • Chairman’s report – the year’s activities
  • Next steps – the year ahead
  • Secretary – membership report
  • Treasurer’s report
  • Proposal for audit exemption
  • Committee – resignations, nominations and elections
  • AOB
If you have any queries or would like more information about the forthcoming AGM please don’t hesitate to contact:

The formal launch will be by a leaflet drop through the letterboxes of the entire parish during week commencing 12th October.

Want to help Save the Henry Jenkins? Become an Associate Member!

The HJCP Ltd is proud to announce the launch of our Associate Membership scheme, for people who would like to support the campaign to Save the Henry Jenkins without the requirement to invest in shares.

An Associate Member increases support for the campaign and receives regular updates and newsletters issued by the society .

Once the pub has been bought, an Associate Member will be invited to provide support in other ways, perhaps by gardening or wielding a saw or a paintbrush during the refurbishment!

Associates are not shareholders so may not vote in shareholders meetings but may attend such meetings by invitation. They may convert to Full Membership at any time by subscribing for shares.

Our Rules and Business Plan always anticipated an Associate Membership scheme but plans for a Spring launch were delayed by Covid-19 restrictions and because these restrictions seem set to continue, we feel that now is the right time.

We hope you will join us by clicking this link and look forward to welcoming you into the Henry Jenkins Community Pub Ltd, Community Benefit Society.

Where we are now!

Coronavirus has devasted the whole country and will continue to do so for a long time yet! Perversely enough, this demonstrates why Kirkby Malzeard really needs a community pub. The name says it all – a pub that is bought by the community and refurbished by the community to serve that same community, is more caring than other establishments (perhaps owned by chains), where profit is the main driving force.

Life still goes on. People still need to socialise, to go out with friends and family. Not able to holiday abroad, people now enjoy a ‘Staycation’ and, with travelling anywhere being awkward, more people than ever are now enjoying meals, drinks and evenings-out closer to home.

Who knows how many pubs will actually survive coronavirus – especially if more lockdowns and curfews are imposed upon the nation? Our early researches show that Community Pubs which are actually owned by the customers that drink there are better placed to survive and thrive. They tend to provide a wider range of services as requested by their local residents and by supporting organisations such as ‘More than a Pub’ and customers young and old feel safer and more comfortable there.

The campaign to save the Henry Jenkins for the village, though slowed by the pandemic and dependent on the result of the forthcoming planning appeal, is still ongoing.

We continue to seek the sale of more Community Shares total which is now less than £20k short of the target and still climbing.

If you can, please invest – help us hit our target!

The Associate Membership scheme for those who want to demonstrate their support but are unable or unwilling to purchase shares will be launched in the next couple of weeks – watch out for the leaflet through your letterbox!

We continue to press the owner for a sale and as soon as the appeal process is over a renewed purchase bid will be placed on the table.

And, perhaps most importantly of all, to prepare for a possible ‘no deal’ scenario, preliminary investigations into a possible Compulsory Purchase Order by Harrogate Borough Council have now already commenced. More details about this will be published in due course.

So please do continue to follow our story. And, if you support the campaign, please join us as a full or associate member.

Finally, we are always happy to know what people think, so please do send us your thoughts and comments. (Contact details below)

COVID-19 & THE HJCP Ltd

During this world-wide crisis our campaign to ‘Save the Henry Jenkins’ will obviously be put on the back-burner. We will continue to work behind the scenes and will keep our members and the public up-to-date with any developments.

We have postponed the official launch of the Associate Membership (for those unable or unwilling to buy shares) but will register anyone who contacts us and wishes to join. They will then get the latest news and updates.

We will continue to seek new full members to achieve our target investment figure of £230k. To date, our 181 members have bought shares to the value of £208,750.00! There is only £20,250.00 to go. Let’s keep on pushing! We can get there!

BUT FOR NOW, WE WOULD ASK EVERYONE TO LEND ALL THEIR ENERGY AND EXPERTISE TO THE CAMPAIGN TO FIGHT CORONAVIRUS!

** The spread of this deadly virus is only in its early stages and will last for many months.
** It will get worse before it starts to get better.
**Please take all the necessary steps to keep yourselves safe and secure
**Be aware of those vulnerable residents who may need special care

In Kirkby Malzeard, the Parish Council and Community Association are co-ordinating efforts to combat Covid-19. Please visit the website: www.kirkbymalzeardarea.org.uk or phone 07401 235046.

Please register to see how you might benefit yourselves and your friends and neighbours through the difficult days ahead…

David Fielder vs HBC

It has been reported that David Fielder attempted to sue Harrogate Borough Council after they imposed the ACV in June 2017.

He claimed £711,000.00, for ‘loss of profits’ because the imposition of the ACV deprived him of ‘permitted development rights’ which would have allowed him to turn the site towards domestic dwellings. He also claimed a sum of £355,000.00 for ‘diminution of value’ for the same reason.

HBC rejected this these claims and a subsequent review upheld that ruling. David Fielder then appealed against the decision. This was heard by a Judge of the First Tier Tribunal, who on the 30th April 2019 supported HBCs case and again refused the claim.

Following subsequent representations, the same Judge refused to review this judgement on 3rd June 2019 but did allow leave for Mr Fielder to apply for yet another appeal, to the 2nd Tier Tribunal.

To date it is not known whether further legal actions have been undertaken. As decisions like this have important implications, not just for the ‘Save the Henry Jenkins’ campaign but for all other community campaigns around the whole country, if further information becomes available, we will publish it here in the “Latest News’ section on our website.

Intimidation

We’ve had some reports of intimidation at our Membership Meeting at the Mechanics Institute on the 26th February. If you experienced this, or saw anything that made you uncomfortable at the time, you should report it. A report will then be submitted to Ripon police to add to the existing file.
Contact Dave at HJCPLtd.com with ‘Intimidation’ in the subject line. Discretion will be maintained.
